What the rewrite is expected to require
The FTC Funeral Rule has not been substantively updated since 1994. The current rule requires:

The 2024-2026 rewrite, signaled in industry coverage and pending under FTC Chairman Khan and successor, is expected to add:

- State-specific overlays (CA, MA, NY, IL already have stricter rules; the federal rewrite is expected to incorporate the highest-bar elements).
- Undercover-shopper enforcement at scale — FTC has been openly increasing in-person inspections; the rewrite is expected to formalize the program.

Where most funeral homes are today
From the available data:
- 75% of funeral home websites currently fail the existing Funeral Rule online-disclosure expectations (LinkedIn theme #6 anchor stat).
- 27% of in-person FTC inspections find Funeral Rule violations (FTC 4-year cumulative finding).
- ~25% of those find SERIOUS violations involving failure to properly disclose prices.
Maximum FTC penalty: $43,792 per violation, doubled for repeat. Most homes that are found in violation are found with multiple stacked violations.

Will Vestamere replace my Funeral Rule lawyer (Poul Lemasters or equivalent)? No. Software handles operational compliance; lawyers handle interpretation and edge cases. If you work with Lemasters or another funeral counsel, Vestamere is the tool they tell you to use. We coordinate where useful.
Does this cover state-specific disclosure rules? Yes for v1 launch states (CO, IL, FL, TX, WA, OR) and the four sharper-than-federal states (CA, MA, NY, IL). Other states default to FTC baseline; we add state coverage on a documented quarterly rhythm.
What about prepayment / pre-need disclosure? Preneed contracts are versioned identically to current GPL. Refund language, cancellation rights, and beneficiary terms are all in plain English by default. (See for-independents.md — no forced arbitration.)
Can I customize my GPL beyond the template? Yes — fully. The template is a starting point. Every line item is editable; you can add specialty services (aquamation, green burial, witnessed cremation, COL events) as their own line items with their own pricing.
